Appeals Court Denies White's Ruling, Janey Can Proceed With Plan To Fire

BOSTON (WBZ NewsRadio) — After review from the Appeals Court, suspended Boston Police Commissioner Dennis White was denied of his appeal. Acting Mayor Kim Janey has the ability to proceed with a hearing to terminate White from his position, following decades-old domestic abuse allegations against him resurfacing.

Appeals Court Judge Vickie Henry on Thursday issued an order stating, “After review of the petition and supporting documents including the Superior Court judge’s thoughtful and detailed memorandum of decision, and order, I discern no error of law or abuse of discretion in the denial of the preliminary injunction.”

On Tuesday, Judge Heidi Brieger denied White’s attempt to stop his firing. He had wanted a preliminary injunction and a temporary restraining order.

In her ruling, Judge Brieger wrote that White “is not entitled to an injunction because he is unlikely to succeed on the merits and has failed to show irreparable harm.”
